Per K.S.A. 22-2202(e), an arrest refers to taking a person into custody to answer for their alleged involvement in a crime. The K.S.A. 22-2401 authorizes law enforcement officers to make an arrest under the circumstances stated below:

  • When there is a warrant authorizing the individual's arrest
  • There is probable cause to believe that an arrest warrant has been issued for a felony committed in Kansas or another state.
  • The officer has probable cause to believe the accused is currently committing or has previously committed a felony or misdemeanor, necessitating immediate arrest.

The Leavenworth County Sheriff's Office is the county's official custodian of arrest records. The records contain details of the arrested person and the event, from booking to sentencing. The Sheriff's Office makes arrest records publicly available to citizens online and in person. Are Arrest Records Public in Leavenworth County?

For example, the Federal Bureau of Prisons (BOP) provides arrest records without charges through its Inmate Locator. The search parameters required are BOP register number, DCDC number, FBI number, or INS number as well as first, middle, or last name and filter the search using race, age, and sex). The U.S. Immigration and Customs Enforcement (ICE) also has an Online Detainee Locator System where individuals can find arrest information using an offender's A-Number or biographical information.

Free Arrest Record Search in Leavenworth County

Individuals can access free arrest records through the Leavenworth County Sheriff's Office's inmate roster. The search criteria are name, race, sex, custody date, or arrest date. Alternatively, record seekers can use third-party portals to find arrest records for free. Unfortunately, third-party vendors only allow free dissemination of basic arrest information. Users interested in downloading or viewing comprehensive arrest records must pay a small access or subscription fee.

How Long Do Arrests Stay on Your Record?

Most arrests stay on a person's records permanently. For example, incarcerated persons' jail/commitment records remain on record forever. Kansas Law allows arrestees to restrict public access to their records through expungement. The Kansas Historical Society (KSHS), through its Retention Schedule portal, highlights the period law enforcement agencies are expected to keep some arrest records in their custody. To find this information, visit the "Local/County" section, select "County Sheriff" from the Agency Name dropdown, and click the search button. According to the retention schedule:

  • Warrants are retained for five (5) calendar years.
  • Felony arrest records are kept for 20 calendar years.
  • Arrest warrant jackets are kept for one (1) calendar year.
  • Medical records of inmates are kept for five (5) years after release.
  • Arrest records of misdemeanors are kept for five (5) calendar years.
  • Arrest records of juveniles are kept until the minor reaches the age of majority.
  • Case files of inmates are kept for five (5) calendar years after the end of the incarceration.
  • Indexes to cases/arrest records are kept until the case index states that it is eligible for destruction.
  • Non-evidential recordings made with mobile recording devices related to an arrest are kept for 90 days.
  • Case files of inmates (temporary holdings) are retained for two (2) calendar years after the end of the incarceration.
  • Arrest case files for murder are retained for 80 calendar years, while those of unsolved murder are permanent.
  • Arrest case files are kept after the statute of limitations expires, plus 20 calendar years for felonies or five (5) calendar years for misdemeanors.

Expunge Leavenworth County Arrest Records

An expungement is a legal process of removing an arrest information from a person's public records. Individuals who want to expunge their arrest records should review the statutes below to determine their eligibility:

  • K.S.A. 38-2312 expungement of records for minors.
  • K.S.A. 22-2410 expungement of arrest records.
  • K.S.A. 12-4516 municipal courts and expungement of certain convictions, arrest records, and diversion agreements.
  • K.S.A. 21-6614 expungement of certain convictions, arrest records, and diversion agreements. (K.S.A. 21-4619 prior to 7/1/2011)

Eligible applicants should complete a Criminal Cover Sheet and Petition for Expungement and file the original and required copies with the Leavenworth County District Court. They must pay a filing fee of $195. Copies of the filings should be served on the Leavenworth County Attorney's Office and the arresting law enforcement agency. Afterward, the petitioner should contact the Leavenworth County Clerk of the Court and ask for a date and time for the hearing. Complete the Notice of Hearing Form, make two (2) additional copies, and file them with the Clerk of the Court. The Clerk will send a copy of the form to the appropriate agencies. Complete the Order of Expungement of Arrest Cover Sheet Form and paragraphs 1 through 4 of the Order for Expungement of Arrest Record Form. The judge will sign the expungement order if the petition is granted. The Clerk of Court will mail a certified copy of the expungement order to the Kansas Bureau of Investigation (KBI). It takes about 2 to 4 weeks for the KBI to process expungement and update the person's criminal history record.

Leavenworth County Arrest Warrants

Per K.S.A. 22-2202(u), arrest warrants are written orders issued by magistrates in Leavenworth County authorizing law enforcement officers to arrest persons named or described in the warrants. A magistrate only issues arrest warrants when they find, from complaints, affidavits, and sworn testimonies, probable cause to believe a crime has been committed and the accused is responsible for it (K.S.A. 22-2302). An arrest warrant form typically contains the following information (K.S.A 22-2304):

  • The magistrate's signature
  • The defendant's name or any name or description that can be used to identify the person
  • A description of the crime charged in the complaint
  • A command that the accused be arrested and brought before a magistrate
  • Bond amount

Only law enforcement officers can execute arrest warrants in Leavenworth County. They can execute warrants anywhere within the state by arresting the defendant. Kansas law does not require officers to have arrest warrants in their possession while executing them, but they must show them to the defendant upon request. The officer must return the arrest warrant to the magistrate before the defendant is brought. While a complaint is pending, a prosecuting attorney may request that a magistrate deliver a returned unexecuted warrant, which is not canceled, to the officer or other authorized person for execution.

Do Leavenworth County Arrest Warrants Expire?

An arrest warrant issued in Leavenworth County can remain active for an extended period and does not automatically expire. According to state law, no specific statute of limitations for enforcing arrest warrants exists. Per K.S.A. 22-2305, a prosecuting attorney may request that an unexecuted arrest warrant returned to the issuing magistrate be canceled.
