According to K.S.A. 22-2401, a law enforcement officer in Wyandotte County may arrest an individual under the following conditions:

  • A warrant has been issued directing the officer to arrest the individual.
  • The officer has probable cause to believe a warrant for the individual's arrest has been issued either in Kansas or another state for a felony committed by that person.
  • The officer has probable cause to believe the individual is currently committing or has previously committed a felony or misdemeanor, necessitating immediate arrest.

Upon arrest, the police officer will take the arrestee to the police station or a local jail. There, the police will book the arrested person by recording their biographical information and taking their fingerprints, mugshots, and pictures of any tattoos. They will also write a report on the arrest. After booking, the arrested person will be taken somewhere to wait to see a judge. This could involve going to the court or a video call with the judge at the police station. The judge will set a bail amount and a hearing date. The arrestee will be released when the bail is paid. If the arrestee is found guilty of the crime during the hearing, they can be asked to pay a fine or sentenced to the Wyandotte County Sheriff’s Office Adult or Juvenile Detention Center, depending on their age.

This service costs $40, and searches can be conducted daily from 4:00 a.m. to midnight (Central Time). Users must sign up for a KanAccess account and log in with their email and secured password.

Applicants can submit a fingerprint or name-based check to retrieve certified copies of their criminal records. Mail a completed Certified Record Check Request form (English or En Español ) and proper payment to the KBI. A name-based certified record check costs $40, and a fingerprint-based certified record check costs $55.

Wyandotte County Arrest Records Vs. Criminal Records

In Wyandotte County, arrest records (also known as arrest folders or files) include personal details of the arrestee, physical descriptions, the time, date, and location of the arrest, charges, disposition, warrant number, the presiding judge’s name, accomplices, the arresting officer, and information on the trial, transportation, and commitment. How Long Do Arrests Stay on Your Record?

Typically, Wyandotte County arrests stay on a person’s record permanently. For example, an arrested person’s jail/commitment records are permanent. However, Kansas Law allows expungement, where arrestees can restrict access to their records. The Kansas Historical Society (KSHS) has a Retention Schedule portal for arrest records.   • Arrest case files are retained after the statute of limitations expires, plus 20 calendar years for felonies or plus five (5) calendar years for misdemeanors.
  • Arrest case files for murder are kept for 80 calendar years, while those of unsolved murder are permanent.

Expunge Wyandotte County Arrest Records

Expungement is the court-ordered removal of a conviction from an arrested person’s criminal history record. Such records become unavailable to members of the public. However, expunged arrest records are still maintained within the Kansas Bureau of Investigation’s (KBI) Computerized Criminal History (CCH) and are released to authorized agencies. Persons who want to expunge their arrest records must meet the eligibility criteria provided in the following state statutes:

  • K.S.A. 12-4516 municipal courts and expungement of certain convictions, arrest records, and diversion agreements.
  • K.S.A. 21-6614 expungement of certain convictions, arrest records, and diversion agreements. (K.S.A. 21-4619 prior to 7/1/2011)
  • K.S.A. 22-2410 expungement of arrest records.
  • K.S.A. 38-2312 expungement of records for minors.

Applicants must file the appropriate form with the court where the case was heard to expunge their arrest records. Petitioners for adult arrest record expungement must file a Petition for Expungement (for adults) with the Wyandotte County District Court. Those whose expungement is for conviction/Diversion & Dismissed Cases should file the form at either the Court’s Traffic (Basement) or Criminal Department (2nd Floor), depending on what department the case is filed in. Individuals interested in arrest record expungements should file thier forms in the Civil Department (3rd Floor). Petitioners must pay a filing fee of $195 filing fee at the Accounting Department on the 3rd Floor before filing the form. Payment can be made by check. Individuals whose case was dismissed must file a Case Dismissed Expungement form, and the court will not charge a fee for this service. Applicants must notarize the 2nd page of the petition in front of a Notary Public before filing it. The District Attorney will do the necessary NCIC checks and notify the victims of the case. If the District Attorney's Office and the victim approve the expungement, the District Attorney's Office will send a certified copy of the Order of Expungement to the petitioner or their attorney. The processing time for arrest records expungement is between six (6) and eight (8) weeks from the filing date.

To apply for juvenile arrest record expungement, the juvenile offender must have reached the age of 18. If the juvenile is less than 18 years of age, their parent or next friend may apply for them. Individuals interested in expunging a juvenile arrest record must file a Petition for Expungement with Wyandotte County District Court’s Juvenile Clerks’ office. Requesters should obtain copies of their Journal Entry or ROA from the Juvenile Clerks’ office to help complete the form. The filing fee for this form is $195, payable by check or money order.

Wyandotte County Arrest Warrants

According to K.S.A. 22-2202, an arrest warrant is a written directive from a magistrate instructing any law enforcement officer to apprehend the individual named or described in the warrant. A Wyandotte County magistrate will issue an arrest warrant when there is probable cause to believe a crime has been committed and that the defendant is responsible (K.S.A. 22-2302). This probable cause is determined from a complaint, an affidavit(s) filed with the complaint, or a sworn testimony. Per K.S.A 22-2304, an arrest warrant has the issuing magistrate’s signature and must contain the following:

  • The defendant’s name, but if it is unknown, can carry any name or the defendant’s identifiable description. The defendant may be identified by a description of their DNA profile, such as an analysis of short tandem repeats (STRs) amplified by the polymerase chain reaction (PCR) technique.
  • A description of the crime charged in the complaint.
  • A command that the defendant be arrested and brought before a magistrate.
  • The amount of the appearance bond

The arrest warrant must be executed by a law enforcement officer and can be executed at any place within Kansas. It is executed by the arrest of the defendant. The law enforcement officer is not required to have the warrant in hand at the time of the arrest but must notify the defendant of the charges and the issuance of a warrant. The officer must show the defendant the warrant as soon as possible when it is requested (K.S.A 22-2305). The executing officer must return the arrest warrant to the magistrate before whom the defendant is brought. All unexecuted arrest warrants may be returned to the issuing magistrate for cancellation at the request of the prosecuting attorney. A magistrate may deliver an arrest warrant returned unexecuted and not canceled to the officer or other authorized person for execution at the request of the prosecuting attorney made while the complaint is pending. Per K.S.A 22-2306, a magistrate is not authorized to quash or abate an arrest warrant, nor can an arrested person be released from custody because of any technical defect.
